In 1874, a military expedition into the Lakota-owned Black Hills led by General George Armstrong Custer confirmed the existence of gold. Although the mission violated the 1868 Treaty of Fort Laramie, which had guaranteed the Sioux rights to their sacred territory and established the Great Sioux Reservation, the area was flooded by thousands of miners, triggering the Black Hills War of 1876.

The original design for Mount Rushmore National Memorial included Presidents George Washington, Thomas Jefferson, Abraham Lincoln and Theodore Roosevelt from head to waist, but Sculptor Gutzon Borglum, who had begun work on the monument in 1927, died before the work was completed, in 1941, and Congress cut off funding as the nation became faced with World War I.

A memorial to the Lakota leader Crazy Horse in South Dakota’s Black Hills is designed to be the largest statue in the world when it is completed. Dedicated by sculptor Korczak Ziolkowski and Lakota Chief Henry Standing Bear on June 3, 1948, the mountain carving will extend 563 feet high and 641 feet long. In June 1998, Crazy Horse’s 87-foot head was completed.

On February 27, 1973, members of the American Indian Movement (AIM) occupied a trading post at Wounded Knee, South Dakota, in protest over corruption within the Oglala Lakota’s Tribal Council and Bureau of Indian Affairs (BIA). The Siege at Wounded Knee, as it became known, lasted 71 days and resulted in the deaths of two Indians following the daily gunfire between AIM members and federal officers.

    Voter registration is a means of determining the candidates and issues for which each voter is eligible to vote. Most states require voters to register to vote a certain number of days before Election Day. Voter Registration also protects the integrity of the ballot box by preventing voting in multiple jurisdictions.

    The powers of the government of the state are divided into three distinct departments, the legislative, executive and judicial; and the powers and duties of each are prescribed by this Constitution.

    Legislative Power

    The legislative power of the state shall be vested in a Legislature which shall consist of a senate and house of representatives.

    The House of Representatives, which has 70 members.

    Judicial Power

    Judicial powers. The judicial power of the state is vested in a unified judicial system consisting of a Supreme Court, circuit courts of general jurisdiction and courts of limited original jurisdiction as established by the Legislature.

    Supreme Court. The Supreme Court is the highest court of the state. It consists of a chief justice and four associate justices. Upon request by the Supreme Court the Legislature may increase the number of justices to seven. All justices shall be selected from compact districts established by the Legislature, and each district shall have one justice.

    Circuit courts. The circuit courts consist of such number of circuits and judges as the Supreme Court determines by rule.

    Authority

    The governor shall be responsible for the faithful execution of the law. He may, by appropriate action or proceeding brought in the name of the state, enforce compliance with any constitutional or legislative mandate, or restrain violation of any constitutional or legislative power, duty or right by any officer, department or agency of the state or any of its civil divisions.

    Qualifications

    The governor and lieutenant governor must be citizens of the United States, have attained the age of twenty-one years, and be residents of the State of South Dakota for two years preceding their election.

    Election

    They shall be jointly elected for a term of four years at a general election held in a nonpresidential election year.

    Term of Office

    They shall be jointly elected for a term of four years.

    Limit on Tenure

    South Dakota governors are restricted to two consecutive terms in office, after which they must wait one term before being eligible to run again.

    Qualification age

    Have attained the age of twenty-one years.

    The Lieutenant Governor
    Authority

    The lieutenant governor serves as president of the state senate, though he or she has no vote unless the full senate is evenly split on a vote and does not perform day-to-day duties in the chamber.

    The Governor and lieutenant governor must be citizens of the United States, have attained the age of twenty-one years, and be residents of the State of South Dakota for two years preceding their election.

    Prosecuting and defending all actions in which the state has an interest, civil or criminal, in the Supreme Court, including all criminal appeals.

    There shall be chosen by the qualified electors of the state at the general election of the Governor and every four years thereafter the following constitutional officers: attorney general, secretary of state, auditor, treasurer, and commissioner of school and public lands, who shall severally hold their offices for a term of four years. Commencing with the 1992 general election, no person may be elected to more than two consecutive terms as attorney general, secretary of state, auditor, treasurer, or commissioner of school and public lands.

    Term of Office

    The attorney general is popularly elected every four years in the midterm elections.

    Limit on Tenure

    Prevents any person from being elected to more than two consecutive terms as attorney general, secretary of state, auditor, treasurer or commissioner of school and public lands.

    Authority

    The secretary is responsible for maintaining official public documents, registering state lobbyists and administrating corporations, among other duties. The secretary also serves as the Chief Elections Officer and Chairman of the State Board of Elections.

    There are no specific qualifications for this office.

    Election

    There shall be chosen by the qualified electors of the state at the general election of the Governor and every four years thereafter the following constitutional officers: attorney general, secretary of state, auditor, treasurer, and commissioner of school and public lands, who shall severally hold their offices for a term of four years.     The Speaker of the House is the presiding officer of the body.

    Qualifications

    No person is eligible for the office of representative who is not a qualified elector in the district from which such person is chosen, and a citizen of the United States, and who has not been a resident of the state for two years next preceding election, and who has not attained the age of twenty-one years.

    Election

    South Dakota state representatives are elected to two year terms.

    Term of Office

    The terms of office of the members of the Legislature shall be two years.

    Limit on Tenure

    No person may serve more than four consecutive terms or a total of eight consecutive years in the senate and more than four consecutive terms or a total of eight consecutive years in the house of representatives.

    The State Senate
    Authority

    The Lieutenant Governor acts as President of the Senate. The President only votes in the case of a tie. The senate elects one member to serve as President pro tempore; this officer presides in the absence of the president, appoints committees, and assigns legislation to committee.

    No person is eligible for the office of senator who is not a qualified elector in the district from which such person is chosen, a citizen of the United States, and who has not attained the age of twenty-one years, and who has not been a resident of the state for two years next preceding election.

    Authority

    The main job of the court is to listen to appeals from the decisions rendered by lower courts in the state. The court also has authority over some original matters, and it can be called on to advise the state's governor regarding executive powers.

    A U.S. citizen A resident of South Dakota A voting resident within the judicial district which he or she will represent. Licensed to practice law in South Dakota. There is a mandatory retirement age of 70

    Election

    Justices of the Supreme Court, judges of the circuit courts and persons presiding over courts of limited jurisdiction must be citizens of the United States, residents of the state of South Dakota and voting residents within the district, circuit or jurisdiction from which they are elected or appointed. No Supreme Court justice shall be deemed to have lost his voting residence in a district by reason of his removal to the seat of government in the discharge of his official duties.
